These terms and conditions apply to all offers, bookings and agreements of Klets & Klei. By booking a workshop, the customer accepts these terms.

Article 1 — Definitions

In these terms and conditions the following definitions apply:

  • Klets & Klei: the sole proprietorship of Sarah Stoter, based in Geldrop, registered with the Dutch Chamber of Commerce under 42076492.
  • Customer: any natural person or legal entity that books or participates in a workshop offered by Klets & Klei.
  • Workshop: a ceramic painting workshop organised by Klets & Klei, including materials, guidance and firing costs.
  • Agreement: the arrangement between Klets & Klei and the customer regarding participation in a workshop.
  • Group booking: a booking for a group of two or more persons.

Article 2 — Applicability

2.1 These terms and conditions apply to all offers, bookings and agreements between Klets & Klei and the customer.

2.2 Deviations from these terms are only valid if agreed in writing.

2.3 By confirming a booking, the customer declares to have read these terms and conditions and to agree to them.

2.4 Klets & Klei reserves the right to amend these terms. The most current version is always available on the website.

Article 3 — Booking and formation of agreement

3.1 A booking can be made via email or via the Klets & Klei website.

3.2 An agreement is formed at the moment Klets & Klei has confirmed the booking in writing (by email).

3.3 For a group booking, the person placing the booking is responsible for payment on behalf of the entire group, unless otherwise agreed.

3.4 Klets & Klei reserves the right to refuse a booking without giving reasons.

Article 4 — Prices and payment

4.1 The price for participation in a workshop is the amount stated on the website or in the quote at the time of booking. All prices include materials, guidance and firing costs, unless stated otherwise.

4.2 Payment must be made before the workshop, unless otherwise agreed in writing. Participation in the workshop is only possible after receipt of full payment.

4.3 In the event of late payment, Klets & Klei reserves the right to cancel the reserved spot.

4.4 Prices may be changed. For already confirmed bookings, the price agreed at the time of booking applies.

Article 5 — Cancellation by the customer

5.1 Cancellation must be communicated to Klets & Klei in writing (by email).

5.2 If unable to attend, the customer has the option to send a replacement at no extra cost, provided this is communicated to Klets & Klei in advance.

5.3 Not showing up without cancellation (no-show) does not entitle the customer to a refund.

Article 6 — Cancellation or changes by Klets & Klei

6.1 Klets & Klei reserves the right to cancel or postpone a workshop in the event of force majeure, illness, insufficient participants or other compelling circumstances.

6.2 Minimum number of participants: a workshop takes place from a minimum of 5 participants. If this minimum is not reached, the workshop will not be cancelled but rescheduled to a later date. The customer will be informed as soon as possible.

6.3 In the event of rescheduling, the payment remains valid for the new date. If the customer cannot participate on the new date, they will receive a full refund.

6.4 If cancelled by Klets & Klei, the full amount paid will be refunded. Klets & Klei is not liable for any additional costs incurred by the customer, such as travel costs.

6.5 In the event of force majeure, Klets & Klei has the right to cancel or reschedule the workshop free of charge. Force majeure means: circumstances beyond the control of Klets & Klei, including illness, extreme weather conditions, fire or government measures.

Article 7 — Participation and house rules

7.1 Participants are expected to arrive on time. In the event of late arrival, Klets & Klei cannot guarantee that the participant can complete the full workshop. No refund applies in that case.

7.2 Participants are expected to follow the instructor’s instructions and to behave respectfully towards other participants and the venue.

7.3 Klets & Klei reserves the right to remove participants who cause nuisance or disrupt the workshop without entitlement to a refund.

7.4 Participation in workshops is at the participant’s own risk. Participants are responsible for informing Klets & Klei of any relevant health conditions or limitations prior to the workshop.

7.5 For participation by minors (under 16 years of age), parental or guardian consent is required. For children’s workshops an adult must be present, unless otherwise agreed.

Article 8 — Collection of ceramics

8.1 After the firing process, the customer will be informed by email about collecting their ceramic work. An estimated processing time will be provided at the time of booking.

8.2 Ceramic work must be collected within 4 weeks of notification. After this period, Klets & Klei has the right to dispose of the work.

8.3 Klets & Klei is not liable for breakage or damage to ceramic work during the firing process, provided this is the result of the nature of the material or the firing and painting process.

Article 9 — Liability

9.1 Klets & Klei endeavours to run workshops safely and properly, but is not liable for:

  • Damage to participants’ personal property during the workshop or at the venue.
  • Injury resulting from careless actions by the participant themselves.
  • Breakage or damage to ceramic work during the firing process due to material or process properties.
  • Indirect damage, consequential damage or lost income.

9.2 The liability of Klets & Klei is in all cases limited to the amount the customer paid for the relevant workshop.

9.3 Klets & Klei holds business liability insurance (AVB).

9.4 Participants are themselves liable for any damage they cause to the venue, materials or personal property of other participants.

Article 10 — Photos and intellectual property

10.1 Klets & Klei may take photos and videos during workshops for use on the website and social media. Participants who object to this may notify Klets & Klei before the workshop.

10.2 Participants are permitted to take photos for personal use. Publication on social media is permitted, provided Klets & Klei is tagged or credited.

10.3 All workshop concepts, materials and designs developed by Klets & Klei are the property of Klets & Klei and may not be copied or used commercially without permission.

10.4 The ceramic work created by the participant during the workshop is the property of the participant.

Article 11 — Complaints

11.1 Complaints about the workshop or service must be submitted as soon as possible, but no later than 14 days after the workshop, in writing via info@kletsenklei.nl.

11.2 Klets & Klei endeavours to respond to complaints within 14 days.

11.3 Submitting a complaint does not suspend the payment obligation.

Article 12 — Privacy

12.1 Klets & Klei processes personal data in accordance with the General Data Protection Regulation (GDPR). For more information please refer to our privacy policy, available on the website.

12.2 Personal data is used solely for the purpose of fulfilling the agreement and is not sold to third parties.

Article 13 — Applicable law and disputes

13.1 Dutch law applies to all agreements between Klets & Klei and the customer.

13.2 Disputes are preferably resolved through mutual consultation. If this is not possible, disputes will be submitted to the competent court in the district where Klets & Klei is established.

13.3 As a consumer, the customer also has the option of using online dispute resolution via the European Commission’s ODR platform (ec.europa.eu/consumers/odr).
